TERMS OF SERVICE

Acceptance

These Terms of Service (“Terms”) apply to use of the HomeCare Evernest website and, where applicable, the general provision of homecare and related services by Home CareEvernest Ltd. By using our website, requesting services, accepting a quotation, booking a service, or otherwise engaging HomeCare Evernest, you agree to these Terms together with any written quotation, work order, service agreement, or other terms specifically provided for your project.

Services

HomeCare Evernest provides homecare and related services that may include residential homecare, elder/senior home care, Alzheimer & dementia care, post-operative home care, companion home care services, homemaking support, long-term care facilities, respite care, nursing care, palliative care, 24/7 home care, and other services offered by HomeCare Evernest from time to time. The applicable quotation, work order, or written agreement determines the exact scope of each job.

Quotes and Scope

Quotes and estimates are based on information available to HomeCare Evernest at the time of quoting. Additional charges may apply where actual site conditions, requested work, access requirements, contamination, damage, excessive buildup, construction debris, hazardous conditions, or additional customer requests materially differ from the information used to prepare the quote. Confirm any material change in scope with the customer where reasonably practicable.

Scheduling and Access

Customers are responsible for providing reasonable access to the property at the scheduled time, including keys, codes, parking/access instructions, and other information necessary to perform the service. Delays caused by lack of access may result in additional charges or rescheduling.

Customer Responsibilities

Customers should remove or identify valuables, fragile items, personal documents, medications, cash, and other items requiring special handling before service. Customers must inform HomeCare Evernest about known hazards, unsafe conditions, pets, restricted areas, water damage, mould concerns, pests, or other conditions that may affect the work or worker safety.

Safety and Right to Stop Work

HomeCare Evernest may refuse, postpone, limit, or stop work where conditions are unsafe, illegal, inaccessible, or outside the agreed scope. This may include hazardous materials, unsafe electrical conditions, structural concerns, severe contamination, aggressive animals, dangerous weather or road conditions, or other circumstances that may reasonably place workers or others at risk.

Results and Existing Conditions

Homecare is intended to improve the condition and wellbeing of individuals and spaces. Still, HomeCare Evernest does not guarantee removal of every stain, odour, discolouration, buildup, damage, or pre-existing condition. Results may depend on the age, material, condition, previous treatment, and type of contamination. Restoration and remediation work depends on the specific project scope and applicable professional requirements.

Payment

Customers are responsible for payment of the amount stated in the accepted quotation, invoice, work order, or service agreement, plus applicable taxes and approved additional charges. Payment terms may vary by customer or project. Late or unpaid balances may be subject to reasonable collection costs and other remedies permitted by law.

Cancellation and Rescheduling

Cancellation and rescheduling terms may be stated in the applicable quotation or service agreement. Where no specific written term applies, HomeCare Evernest may charge reasonable costs incurred because of late cancellation, missed access, or reserved staff/equipment, to the extent permitted by applicable law.

Photos and Work Documentation

HomeCare Evernest may document work conditions, progress, and completion through photographs or video for operational, quality-control, safety, insurance, restoration, or dispute-resolution purposes. Any public marketing use of identifiable customer/property images should be handled in accordance with applicable privacy requirements and any applicable customer consent.

Limitation of Liability

To the extent permitted by law, HomeCare Evernest will not be responsible for loss or damage arising from pre-existing conditions, ordinary wear, fragile or improperly installed items, hidden defects, conditions not disclosed to HomeCare Evernest, or circumstances outside Home Care Evernest’s reasonable control. Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

Third-Party Websites and Services

The HomeCare Evernest website may contain links to third-party websites, booking platforms, payment services, social media platforms, or other services. HomeCare Evernest is not responsible for the privacy practices, content, security, or availability of third-party websites or services.

Governing Law

These Terms are governed by the laws of the Province of Manitoba and the applicable laws of Canada. Any dispute will be addressed in accordance with applicable law and any enforceable agreement between the parties.

Changes to These Terms

HomeCare Evernest may update these Terms from time to time. We may post updated Terms on the website. Terms specifically agreed in a signed contract, quotation, work order, or service agreement may continue to govern the applicable project where they conflict with general website terms.
